Terms and Agreements

​GENERAL RULES

• Gym is open 24/7, please use at your own discretion.

• Pets are not permitted.

• Smoking and/or vaping is not permitted on the premises.

• You may NOT take pictures or videos of other members without their consent!

• No alcohol or drugs on the premises.

• Return weights after use.

• Do not steal any equipment/gym property.  We have 24/7 camera monitoring, and it will be used as evidence to report you to the local authorities.  You will be liable for any damages or theft.

• Do not act aggressive towards others while on the premises.

• Children under 16 must be accompanied by an adult while working out.

1.  ACCESS AND USE:

The Member is granted 24-hour access to Duggins Gym and agrees to comply with all rules, regulations, and policies of the gym.

2.  LETTING OTHERS IN:

If you knowing let anyone without a membership into the facility, or allow someone to use your membership, your account will be charged $35 per person that you allow to do so.

3.  SUSPENSION AND TERMINATION:

Duggins Gym reserves the right to suspend or terminate this membership without providing a reason or justification.

4.  LIABILITY WAIVER:

The Member acknowledges that using the gym facilities involve certain risks and agrees to sign the Duggins Gym waiver and release agreement.

5.  PERSONAL INFORMATION AND PRIVACY:

Duggins Gym will collect and store personal information in accordance with applicable privacy laws and regulations.

6.  MISCELLANEOUS:

All equipment, and free weights must be racked and well taken care of.  Any damages to the gym equipment, or structure due to neglect, horseplay, etc. will be accountable for all cost of repairs and will immediately no longer have access to Duggins Gym.

AMENDMENTS:

Any changes to this Contract must be in writing and signed by both parties.

GOVERNING LAW:

This Contract shall be governed by the laws of Louisiana/United States.

ENTIRE AGREEMENT:

This Contract constitutes the entire agreement between the parties and supersedes all prior discussions, agreements, or understandings.

*Pre-Paid Memberships will not be refunded.  

*Memberships are non-transferrable.

CANCELING A CONTRACT:

If you cancel a contract before term is up it will result in a $100 cancellation fee.  All payments must be current and request for cancellation must be in writing, submitted to LiftAndLive@DugginsGym.com within 15 days of the next scheduled auto draft date.

FAILURE TO PAY CONTRACT:

After 60 days of no payment your remaining balance will be turned over to collections.​

After 5 days a late fee of $10 will be charged to your account.

CLUB ENHANCEMENT FEE:

The Club Enhancement Fee is intended to support the maintenance and continuous improvement of the equipment and services we offer.  This ANNUAL fee applies to ALL active members!

**This ANNUAL fee of $35 will be collected March 1st of EVERY year.

UPON SIGNING UP FOR A MEMBERSHIP, THE FOLLOWING FEES ARE DUE AT THE TIME OF ENROLLMENT:

1.  First Month's Membership, plus applicable taxes.

THESE FEES ARE REQUIRED TO ACTIVATE YOUR MEMBERSHIP!​

By signing up for a membership at DUGGINS GYM, you confirm that you are at least 17 years of age.  If it is discovered that you misrepresented your age during registration, your membership may be terminated immediately without refund.  Additionally, any fees, including the cancellation fee, will remain applicable.  Duggins Gym reserves the right to request proof of age at any time.
